Judge upholds marijuana ban

— A Chelan Superior Court Judge ruled against a business wanting to open a marijuana retail store.

Judge T.W. Small sided with the city in the case of SMP Retail LLC v. city of Wenatchee.

The business had sued the city in its effort to open a marijuana retail store under provisions approved by voters statewide through Initiative 502. The city has banned retail marijuana businesses.

Small is the second judge to uphold retail marijuana bans for cities opposing the state measure.

In the first case, Pierce County Superior Court Judge Ronald Culpepper found in favor of the city of Fife in a lawsuit filed by MMC LLC.

That firm has appealed the decision to the Washington State Supreme Court.
