State high court sends Three Devils case back to appeals court

OLYMPIA – The state Supreme Court has sent the lawsuit over vacation of Three Devils Road to the Division III Court of Appeals rather than hear the case directly.

In an order issued June 29, a three-justice panel of the high court sent the Coalition of Chiliwist Residents and Friends’ appeal of an Okanogan County Superior Court decision to the appeals court rather than hearing it directly.

The coalition sued Okanogan County over a decision to vacate the road, which leads out of the Chiliwist and connects with roads that go into the Methow Valley and south to Brewster. They contend the road is an escape route in case of emergency such as fire or flood.
