Two Republic men face charges in Ferry County Superior Court after an incident Sept. 27 in which they allegedly attempted to ram another vehicle on Highway 20 over Sherman Pass and run it off the road.
Charges were filed Oct. 2 against Jess E Davis, 21, Republic, and Michael Brisbane, 20, Republic, according to court documents.
Each is charged with two counts of second-degree assault and two counts of unlawful imprisonment, according to court documents.
Davis also is charged with driving while intoxicated and unlawful possession of a firearm while Brisbane faces charges of minor driving after consumption of alcohol and unlawful carrying of a firearm, court documents indicate.
Five other individuals, passengers in Brisbane’s and Davis' vehicles, also were involved. Some of were juveniles and more charges are anticipated in the case, according to Ferry County prosecutor Mike Sandona.
The incident started with Brandon Gregory and another individual texting about a girl, Sandona said.
They were going to meet and fight it out, but Gregory apparently decided against that and left in his car, Sandona said.
Law enforcement got involved at about 2 a.m. when Gregory called 911 and reported that two vehicles were attempting to run him off Highway 20 eastbound toward Sherman Pass, according to court documents.
The victim said the vehicles were ramming his vehicle and boxing him in so he could not escape, according to couty records.
Ferry County sheriff's deputy Boone and Washington State Patrol trooper A.J. Haddenham were dispatched to Karamip Road, where the vehicles were stopped,.
Two vehicles were boxing Gregory in and suspects were attempting to enter his vehicle, court documents allege.
The deputy observed the three vehicles and several people standing around the center vehicle, which belonged to Gregory, court papers continued.
Gregory allegedly told the deputy the front vehicle driven by Brisbane was boxing him in and Davis' vehicle prevented him from escaping to the rear.
Gregory also told Boone that Davis rammed his vehicle several times and that he nearly crashed and thought he was going to die, according to court documents.
Haddenham allegedly observed heavy breaking skids in the gravel at the location from all three vehicles indicating a forced and rapid stop.
Davis then pulled across the road behind Gregory, stopping any attempt on his part to leave and creating an unlawful imprisonment of Gregory and his passenger Stephen Berry, according to court documents.
Seven suspects from the two vehicles exited and began trying to break out Gregory's windows and create a physical altercation, the charges allege.
During the search incident to arrest, a loaded shotgun was located in Davis' vehicle, court records allege. A routine check revealed that he was a convicted felon and could not have a firearm in his possession, documents indicate.
Davis pleaded guilty to first-degree malicious mischief in February 2007 for his part in running a front-end loader into Republic High School in November 2006.
Also during the search, a loaded .22-caliber pistol was located in Brisbane's vehicle, according court records. Neither Brisbane nor anyone in his vehicle was 21 years and could not legally possess a handgun, according to court documents.
A routine check allegedly revealed that Brisbane was driving while his license was suspended.
Presence of loaded firearms is especially dangerous in that kind of situation where the combined effects of alcohol, poor judgment and temper could easily lead to their use, court documents say Haddenham wrote in his report.
Additionally, there was the dangerous situation created by two intoxicated subjects using their vehicles as weapons to force someone off the roadway, according to the trooper's report.
Brisbane and Davis were booked into Ferry County jail while the others provided written statements about the incident then were released to responsible adults, according to court documents.
Bail was set initially in District Court at $1,000 for Brisbane and $2,000 for Davis, but was raised in Superior Court to $6,000 for Brisbane and $10,000 for Davis.
Brisbane made bail, but Davis was still in custody as of Saturday, Oct. 4.
